History

Bail Fund

Background on the problem

The Massachusetts Bail Fund was founded in the spring of 2010 by a group of attorneys, social workers, and other community members concerned with addressing the inequities of the legal system, particularly its impact on poor people and people of color. The Bail Fund is available to poor and low income clients represented by court appointed attorneys throughout the state.

Modeled after the highly successful Bronx Freedom Fund which began in 2007, the Massachusetts Bail Fund’s Steering Committee accepts referrals for eligible candidates and decides to post bail for those individuals who meet its criteria, based on availability of funds. Indigent defendants are assessed for their community ties and history of court compliance. Clients will also be referred to community services for additional support. Upon completion of the court case, the money used for the bail will be returned to the fund for use in other cases.
